Terms of service

1. Who we are

Play Dirty is operated by neonstudio.ai ("we", "us"). These terms are an agreement between you and us about your use of the Play Dirty app and website (the "Service").

2. Accepting these terms

You accept these terms, and our Privacy Policy, when you tap the button to go into the game, or the button to join someone else's game from your phone. Both buttons say so beside them. If you do not accept them, do not use the Service. When we change these terms in a way that matters, we ask you to accept them again the next time you come in.

3. Eligibility

By using the Service you confirm that you are at least 18 years old and old enough to view sexually explicit material where you are, and that doing so is legal there. Do not use the Service, or let anyone else use it with you, if that is not true.

4. What the Service is

Play Dirty is a party game of written dares and questions for consenting adults. It contains text only. It does not contain photographs, video or any other visual depiction of real people.

Levels 1 and 2 are free. Levels 3 to 6 need a paid pass or a promo code, described in Billing & refunds.

5. Consent and safety

• Every card is optional. Any player can pass any card, and any player can stop the game at any time with the safeword.
• Do not play with anyone who has not freely agreed to, or who is too intoxicated to agree.
• Some cards involve physical activity, including impact play and pressure on the body. Only do what everyone involved has agreed to, stop at once if anyone asks, and skip anything a health condition, injury or medication makes unwise for you.
• Safety notes on cards are general guidance, not medical advice. You take part at your own risk, and you are responsible for your own choices and for how you treat other players.
• Nothing in the Service asks you to do anything illegal where you are. If a card would be, skip it.

6. Alcohol

• Shots are an optional penalty the table can switch off before the game starts. Only drink if you are of legal drinking age where you are, never drink and drive, and never pressure anyone to drink. Nothing in the Service involves drugs.
• Moving back a space is always available instead, and costs nothing.

7. Playing across phones

The device that starts a game can open a room so other players join from their own phones. Everyone who joins must be 18 or over and accept these terms when they join. The person who opens a room decides who to share it with, and is responsible for inviting only adults who have agreed to play. How rooms work, and what passes through our servers, is explained in the Privacy Policy.

8. Purchases

• Hot pass: one payment unlocks levels 1 to 4 for 24 hours from purchase.
• Filthy pass: one payment unlocks levels 1 to 6 for 24 hours from purchase.
• Passes do not renew. There are no subscriptions.
• Promo codes unlock a pass without payment for the time stated when the code was issued. They have no cash value and can be withdrawn.
• Payments are processed by CCBill, LLC, our authorized sales agent. Your card details go to CCBill, not to us, and CCBill's own terms also apply to the payment.
• A purchase can be used on up to 4 devices. Adding a fifth signs out the oldest.
• Prices may change. A change never affects a pass you have already bought.

9. Your licence

We grant you a personal, non-exclusive, non-transferable licence to use the Service for private, non-commercial play. The players at your table, including anyone who joins a room you open, may play along under your purchase while you play together. You may not copy, publish, resell or redistribute the cards or the app, share a purchase for play you are not part of, or try to get around the paywall.

10. Ending access

We may suspend or end access for breach of these terms, fraud, or a chargeback. A refunded or charged-back purchase stops unlocking the levels it unlocked.

11. Disclaimers

The Service is provided "as is". To the fullest extent the law allows, we make no warranties about it and are not liable for any indirect or consequential loss, for injury or loss arising from how players choose to act on a card, or for anything that happens between players. Our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing here limits rights you have that cannot be limited by law.

12. 18 U.S.C. §2257

The Service contains no visual depictions of actual or simulated sexually explicit conduct. It consists of written text only, so the record-keeping requirements of 18 U.S.C. §2257 and 28 C.F.R. Part 75 do not apply to it.

13. Changes and law

We may update these terms; the effective date above will change when we do. These terms are governed by the laws of the State of Nevada, USA.
